These terms apply to your use of purpleduckling.com and the Day2Day apps made by Purple Duckling Inc. (“Purple Duckling,” “we,” “us”). By using our website or apps, you agree to these terms. If you don’t agree, please don’t use them.

Our apps

Day2Day Calendar is sold through Apple’s App Store. Your use of the app is also governed by Apple’s Licensed Application End User License Agreement. If these terms and Apple’s agreement conflict about the app, Apple’s agreement applies. Purchases, refunds and billing are handled by Apple under Apple’s policies.

A tool for caregivers, not a treatment

Day2Day is designed to give visual and auditory support. It is not a medical, therapeutic or educational treatment, and it does not replace the support, supervision or judgment of a parent, caregiver, teacher or professional. Nothing on our website or in our apps is medical or professional advice.

You are responsible for setting up schedules, activities and rewards that are safe and appropriate for the person you support, and for supervising them as needed.

Your content

The schedules, pictures, recordings and other content you add to our apps belong to you and stay on your device. Please only add pictures and recordings you have the right to use.

Our content

Our website, apps, names, logos, pictures and text belong to Purple Duckling or the people we license them from. You may use them to use our apps and website as intended, but you may not copy, resell or redistribute them without our written permission.

Using our website

Please don’t misuse our website, for example by trying to interfere with how it works, access it in ways we haven’t made available, or submit false information through our forms.

Links to other websites

Our website and apps may link to other websites, such as the App Store, Google Image Search or research sources. We don’t control those websites and aren’t responsible for their content or practices.

Disclaimer

We work hard to make our website and apps helpful and reliable, but we provide them “as is” and “as available.” To the extent the law allows, we make no promises that they will always be available, error-free, or right for every person.

Limitation of liability

To the extent the law allows, Purple Duckling is not liable for indirect, incidental or consequential damages arising from your use of our website or apps. If we are found liable, our total liability is limited to the amount you paid for the app.

We may update these terms. If we do, we’ll post the new version on this page and update the date at the top. If you keep using our website or apps after a change, you accept the updated terms.

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.
